Le traitement des données décrit ci-dessous est réalisé par le cabinet de kinésithérapie qui exploite l'application SomaLynk. Pour toute question relative à la présente politique ou à l'exercice de vos droits, contactez philippetadger@gmail.com.
2Données collectées
- Identité — nom, prénom, numéro de registre national (NISS), date de naissance, sexe, langue, adresse, téléphone, e-mail
- Coordonnées de contact — adresse postale, téléphone, e-mail, personne de contact
- Données de santé et de traitement — notes de séance, zones traitées, scores cliniques, diagnostic, prescriptions médicales et documents associés
- Données de rendez-vous — dates, heures, statut des séances, historique de calendrier
- Données de facturation et de paiement — codes de nomenclature INAMI, montants, factures, moyens de paiement
- Données de connexion — horodatage des connexions, adresse IP, journal d'accès aux dossiers
3Finalités du traitement
- Assurer le suivi et la dispensation des soins de kinésithérapie
- Respecter les obligations légales de facturation auprès de l'INAMI et des mutualités
- Gérer les rendez-vous et l'organisation du cabinet
- Assurer une communication sécurisée avec les patients (portail, rappels, notifications)
4Base légale
- Exécution du contrat de soins conclu avec le patient
- Obligations légales (nomenclature INAMI, comptabilité, conservation des dossiers de santé)
- Consentement du patient, lorsque celui-ci est requis (par exemple pour certaines communications)
5Durée de conservation
Les dossiers de santé sont conservés conformément aux obligations légales belges de conservation applicables aux professions de santé. Les données comptables et de facturation sont conservées conformément à la législation comptable en vigueur. Au-delà de ces durées, les données sont supprimées ou anonymisées.
6Partage des données
SomaLynk ne vend aucune donnée personnelle et n'utilise aucun outil publicitaire ou traceur d'analyse comportementale. Les données ne sont partagées qu'avec :
- Les organismes assureurs (INAMI, mutualités) dans le cadre strict des obligations de facturation
- Un prestataire de comptabilité (Billit) pour la tenue des comptes du cabinet
- Des prestataires techniques d'hébergement, soumis à des garanties contractuelles conformes au RGPD
7Notifications push
Lorsque l'application mobile envoie une notification push, le contenu de celle-ci reste générique (par exemple : « Vous avez un nouveau message »). Aucun détail de santé, aucun nom de patient ni aucune information clinique ne transite par les serveurs des fournisseurs de notifications push.
8Vos droits (RGPD)
Vous disposez des droits suivants sur vos données personnelles :
- Droit d'accès à vos données
- Droit de rectification des données inexactes
- Droit à l'effacement, dans les limites des obligations légales de conservation
- Droit à la portabilité de vos données
- Droit d'introduire une réclamation auprès de l'autorité de contrôle compétente : l' Autorité de protection des données (autoriteprotectiondonnees.be)

2Verzamelde gegevens
- Identiteit — naam, voornaam, rijksregisternummer (NISS), geboortedatum, geslacht, taal, adres, telefoon, e-mail
- Contactgegevens — postadres, telefoon, e-mail, contactpersoon
- Gezondheids- en behandelgegevens — sessienotities, behandelde zones, klinische scores, diagnose, medische voorschriften en bijbehorende documenten
- Afspraakgegevens — data, uren, sessiestatus, agendageschiedenis
- Facturatie- en betaalgegevens — RIZIV-nomenclatuurcodes, bedragen, facturen, betaalmiddelen
- Verbindingsgegevens — tijdstip van aanmelding, IP-adres, toegangslogboek van de dossiers
3Doeleinden van de verwerking
- Verzekeren van de opvolging en verstrekking van kinesitherapeutische zorg
- Naleven van de wettelijke facturatieverplichtingen tegenover het RIZIV en de ziekenfondsen
- Beheren van afspraken en de organisatie van de praktijk
- Verzekeren van beveiligde communicatie met patiënten (portaal, herinneringen, meldingen)
4Rechtsgrond
- Uitvoering van de zorgovereenkomst met de patiënt
- Wettelijke verplichtingen (RIZIV-nomenclatuur, boekhouding, bewaring van gezondheidsdossiers)
- Toestemming van de patiënt, waar vereist (bijvoorbeeld voor bepaalde communicatie)
5Bewaartermijn
Gezondheidsdossiers worden bewaard overeenkomstig de Belgische wettelijke bewaarverplichtingen voor zorgverleners. Boekhoud- en facturatiegegevens worden bewaard overeenkomstig de geldende boekhoudwetgeving. Na afloop van deze termijnen worden de gegevens verwijderd of geanonimiseerd.
6Delen van gegevens
SomaLynk verkoopt geen persoonsgegevens en gebruikt geen advertentietools of trackers voor gedragsanalyse. Gegevens worden enkel gedeeld met:
- De verzekeringsinstellingen (RIZIV, ziekenfondsen) binnen het strikte kader van de facturatieverplichtingen
- Een boekhouddienstverlener (Billit) voor de boekhouding van de praktijk
- Technische hostingproviders, gebonden door contractuele waarborgen conform de AVG
7Pushmeldingen
Wanneer de mobiele applicatie een pushmelding verstuurt, blijft de inhoud ervan generiek (bijvoorbeeld: "U heeft een nieuw bericht"). Geen enkel gezondheidsdetail, geen patiëntennaam en geen klinische informatie passeert via de servers van de aanbieders van pushmeldingen.
8Uw rechten (AVG)
U beschikt over de volgende rechten met betrekking tot uw persoonsgegevens:
- Recht op inzage in uw gegevens
- Recht op verbetering van onjuiste gegevens
- Recht op gegevenswissing, binnen de grenzen van de wettelijke bewaarverplichtingen
- Recht op overdraagbaarheid van uw gegevens
- Recht om een klacht in te dienen bij de bevoegde toezichthoudende autoriteit: de Gegevensbeschermingsautoriteit (gegevensbeschermingsautoriteit.be)

3Purposes of processing
- Providing and following up physiotherapy care
- Meeting legal billing obligations towards INAMI and the mutual health insurers
- Managing appointments and the organisation of the practice
- Ensuring secure communication with patients (portal, reminders, notifications)
4Legal basis
- Performance of the healthcare contract concluded with the patient
- Legal obligations (INAMI nomenclature, accounting, retention of health records)
- The patient's consent, where required (for example for certain communications)
5Retention period
Health records are retained in accordance with the Belgian legal retention obligations applicable to healthcare professionals. Accounting and billing data are retained in accordance with the accounting legislation in force. Beyond these periods, data are deleted or anonymised.
6Data sharing
SomaLynk sells no personal data and uses no advertising tools or behavioural-analytics trackers. Data are shared only with:
- The insurance institutions (INAMI, mutual health insurers) within the strict scope of billing obligations
- An accounting provider (Billit) for the practice's bookkeeping
- Technical hosting providers, bound by contractual safeguards compliant with the GDPR
7Push notifications
When the mobile application sends a push notification, its content remains generic (for example: "You have a new message"). No health detail, no patient name and no clinical information transits through the push-notification providers' servers.
8Your rights (GDPR)
You have the following rights over your personal data:
- Right of access to your data
- Right to rectification of inaccurate data
- Right to erasure, within the limits of legal retention obligations
- Right to data portability
- Right to lodge a complaint with the competent supervisory authority: the Belgian Data Protection Authority (dataprotectionauthority.be)
